Letter Of Intent
Interested parties should submit a Letter of Intent indicating the property of interest and details for the proposed project or event. The letter should include the following information:
- Applicant name, company, and contact information
- Description of the project/event
- The dates and times for project/event, including alternative dates and times
- The type of equipment that will be used, including vehicles, if any
- The types of structures to be erected, if any
- Anticipated number of occupants known and/or anticipated for the project/event (i.e., cast, crew, guests, etc.)
- Details on children (under age 18) who will perform in and/or attend the project/event– specify child’s age and scope of activity
- Details on the use of animals, firearms, or special effects, if any
- Detailed use schedule – for each day of project/event, a detailed schedule of estimated dates, times, number of people and activities to be performed; and
- Any additional information relevant to the project/event
NYCEDC reserves the right to require additional information from the applicant including an Internal VENDEX Investigation Questionnaire. Letter of Intent must be received no later than ten (10) business days prior to the project/event. Upon review and approval of Letter of Intent, NYCEDC will issue a revocable Temporary Use Permit. Permit issuance is conditioned upon the permit applicant’s compliance with any additional permit, insurance, and other requirements pursuant to municipal, state and federal laws, rules and regulations.
Requirements for Temporary Use Permit
The information below summarizes the minimum requirements of NYCEDC’s Temporary Use Permit. The information is for summary reference only and does not modify the requirements or language of the final Temporary Use Permit.
Temporary Use Permit Minimum Requirements
Period
- The period of usage shall not exceed twenty-nine (29) calendar days unless otherwise authorized.
- The property shall be available between the hours of 7:00 am to 11:59 pm unless otherwise authorized.
- The permit by can be revoked NYCEDC at any time. Permit applicant must promptly vacate the property upon 24-hours’ written notice.
Use
- The property may only be used for the purposes authorized under the permit issued.
- Permit applicant must provide a detailed use schedule prior to the commencement of any use.
Charge/Payment
- The rental rate will be between $5,000 and $10,000 per production day depending on the scope of the event; and between $1,000 and $2,000 per set-up/break-down day.
- Payment will be made prior to commencement of project or event.
- Permit applicant will be responsible for payment of utility costs incurred during the period of use. Utility costs shall include water and sewer charges, gas, heat, and electricity.
- A security deposit will be required as collateral security for permit applicant’s obligation to pay utility costs and any additional charges that may become due. The deposit will be returned, without interest, to permit applicant within thirty (30) days after the expiration or termination of the permit.
- All payments must be made by certified check or money order.
Insurance
- Permit applicant must provide NYCEDC with an Accord Certificate of Insurance written on an ISO Form CG 00 01 (10/01), or its equivalent, with the minimum insurance coverage listed below.

- The certificate must be delivered to NYCEDC no later than three (3) days prior to the scheduled project/event.
- Permit applicant may be required to maintain additional insurance based on the permitted use of the property.
Insurance policies must name the following as additional insureds:
- The City of New York
- New York Economic Development Corporation
- Apple Industrial Development Corp
Coverage for additional insureds shall be written into required policies as an endorsement at least as broad as ISO Form CG 20 10 (07/04 ed.).
Policies shall only be issued by insurance companies that are authorized to do business in New York State and have a rating in the latest edition of “Bests Key Rating Guide” of “A:VII” or better.
Indemnification
Permittee shall agree to defend, indemnify and hold harmless the City, NYCEDC, Apple and their respective members, agents and employees from any and all claims, judgments or liabilities for personal injury, including death, and property damage, caused by acts or omissions of the permittee, its agents, employees and subcontractors, and arising out of or occurring during the permittee’s use and occupancy of the property.
